The Family and Medical Leave Act (FMLA) is a federal law which requires certain employers, including the State of Maryland, to grant job protected leave to employees who meet FMLA’s eligibility requirements. You can not be fired for taking time off to care for your child.
12 weeks of unpaid leave each year for any of the following reasons:
- For the birth and care of the newborn child of an employee;
- care for the employee’s spouse, child, or parent with a serious health condition, or an adult child who cannot care for himself or herself
- Employees are eligible for leave if they have worked for their employer at least 12 months
- Work at a location where the company employs 50 or more employees within 75 miles.

Obtain – Obtain FLMA Form
Ask – Ask your child’s healthcare professional to complete form
Make – Make a copy for your records
Submit – Submit to Human Resources on your job
